If a client wishes to purchase digital image the following licensing agreement must be agreed to by client at or before time of purchasing digital images. receipt of digital images from witness light studio, or it's representative, will constitute acceptance of this agreement.

1. PURPOSE OF THIS LICENSE
This Digital Image License Agreement (“License”) establishes the rights granted by Witness Light Studio, LLC (“Photographer”) to the individual or entity identified above (“Client”) regarding digital photographic images delivered to Client.
The photographs remain the intellectual property and copyrighted works of the Photographer. This License grants Client permission to use the delivered images according to the terms below but does not transfer ownership or copyright in the photographs.
By downloading, receiving, or using the digital images, Client acknowledges and agrees to the terms of this License.
2. COPYRIGHT OWNERSHIP
All photographs created by Witness Light Studio, LLC remain protected by applicable copyright law.
Unless otherwise agreed to in a separate written agreement, Witness Light Studio, LLC retains all copyrights and intellectual-property rights in the photographs, including the exclusive rights to reproduce, distribute, display, publish, modify, and otherwise exploit the photographs as permitted by law.
Delivery of digital files does not constitute a transfer of copyright ownership.
3. PERSONAL USE LICENSE
Subject to the terms of this License, Client is granted a non-exclusive, non-transferable license for personal use of the delivered digital images.
Personal use includes, but is not limited to:
Downloading and storing the images for personal records.
Printing photographs for personal use.
Creating personal photo books, albums, cards, and similar personal products.
Sharing the photographs with family and friends.
Posting the photographs on personal social-media accounts.
Using the photographs as personal profile or cover images.
Displaying the photographs in the Client's home or other private setting.
Making reasonable copies for personal backup purposes.
Client may share the photographs online for personal purposes provided that the photographs are not being used to promote a business, product, service, organization, or commercial activity without written permission from the Photographer.
4. SOCIAL MEDIA USE
Client is welcome to share licensed images on personal social-media accounts.
When reasonably possible, Client is encouraged to provide attribution to Witness Light Studio and/or tag the studio when posting the images.
Client may not remove or obscure a watermark, copyright notice, metadata, or other identifying information intentionally placed on an image by the Photographer.
5. PRINTING AND PERSONAL PRODUCTS
Client may use the delivered digital images to obtain personal prints and photographic products from a laboratory or printing service of Client's choice.
Client may authorize a professional print laboratory to reproduce the images solely for the purpose of fulfilling Client's personal print or product order.
The laboratory may not use, publish, sell, distribute, or otherwise exploit the photographs for any other purpose.
6. PROHIBITED USES
Unless separately authorized in writing by Witness Light Studio, LLC, Client may not:
Sell, license, sublicense, or otherwise distribute the digital images to another person or entity for commercial use.
Use the photographs to advertise or promote a business, product, service, organization, or commercial activity.
Submit the photographs to publications, contests, advertisements, stock-photography services, or commercial campaigns where the Client or another party receives compensation or commercial benefit.
Sell the digital files or physical reproductions for profit.
Claim authorship or copyright ownership of the photographs.
Register the photographs with a copyright office or other intellectual-property registry as the Client's own work.
Use the photographs to create derivative commercial artwork, merchandise, products, or promotional materials without written permission.
Grant another person or organization rights to use the photographs that exceed the rights granted by this License.
Intentionally remove or alter copyright notices, watermarks, or metadata placed on the photographs by the Photographer.
7. EDITING AND ALTERATIONS
Client may make reasonable personal-use adjustments to the photographs, such as cropping or resizing for printing or social-media display.
Client may not substantially alter, manipulate, or edit the photographs in a manner that misrepresents the Photographer's work without written permission.
This includes, but is not limited to:
Applying heavy filters or presets that substantially change the photograph.
Adding or removing significant elements.
AI-generated alterations or transformations.
Changing the photograph into another artistic style.
Combining the photograph with other imagery to create a substantially different work.
Routine resizing, cropping, or minor adjustments necessary for personal printing or online posting are permitted.
8. COMMERCIAL AND BUSINESS USE
Any commercial use of the photographs requires a separate written license from Witness Light Studio, LLC.
Commercial use may include, but is not limited to:
Business websites.
Business social-media accounts.
Advertising.
Marketing materials.
Product packaging.
Promotional campaigns.
Paid publications.
Commercial editorial use.
Real-estate marketing beyond the rights specifically granted in a separate agreement.
Use by corporations, organizations, or other commercial entities.
Commercial licensing terms, fees, and permitted uses will be determined separately based upon the intended use.
9. THIRD-PARTY USE
Client may not grant third parties permission to use the photographs for purposes beyond the personal-use rights granted by this License.
If another individual, business, publication, organization, or entity wishes to use a photograph commercially, that party should contact Witness Light Studio, LLC directly for licensing authorization.
10. MODEL AND PRIVACY CONSIDERATIONS
Client understands that photographic copyright ownership and a person's rights concerning their likeness are separate matters.
Client is responsible for obtaining any permissions that may be required for Client's own commercial use of photographs containing other individuals.
Nothing in this License grants Client the right to use another person's likeness for commercial purposes where such use would otherwise require that person's permission.
11. PHOTOGRAPHER'S RIGHTS
Nothing in this License limits rights retained by Witness Light Studio, LLC under applicable copyright law or under any separate photography agreement between the Photographer and Client.
Unless a separate written agreement provides otherwise, the Photographer retains the right to display photographs for portfolio, studio, website, social-media, competition, sample, promotional, and other lawful business purposes, subject to any applicable privacy, model-release, or contractual restrictions.
12. NO TRANSFER OF COPYRIGHT
The purchase or delivery of digital images does not constitute a sale or transfer of copyright.
Client receives a license to use the delivered photographs as described in this Agreement. All rights not expressly granted to Client remain with Witness Light Studio, LLC.
13. LICENSE TERMINATION
If Client materially violates this License, Witness Light Studio, LLC may terminate the license upon written notice.
Upon termination, Client must cease any use of the photographs that is no longer authorized under this License, except where continued possession is required by law or where otherwise agreed in writing.
Termination does not eliminate any rights or remedies the Photographer may have under applicable law.
14. DIGITAL FILES AND ARCHIVING
Client is responsible for maintaining appropriate backups of delivered digital photographs.
Witness Light Studio, LLC may maintain archival copies of delivered images as part of its normal business practices but does not guarantee permanent storage or future availability of digital files.
Client should maintain multiple backups of important photographs.
15. GOVERNING LAW
This License shall be governed by and interpreted according to the laws of the State of Montana, without regard to conflict-of-law principles.
Any legal action arising from this License shall be subject to the jurisdiction of courts having appropriate authority under applicable law.
16. ENTIRE AGREEMENT
This License constitutes the agreement between Witness Light Studio, LLC and Client concerning the permitted use of the delivered digital photographs, except where a separate written photography contract or licensing agreement expressly modifies these terms.
Any modification or additional commercial license should be made in writing.
CLIENT ACKNOWLEDGMENT
By downloading, receiving, or using the digital photographs, Client acknowledges that they have read and agree to the terms of this Digital Image License Agreement.

1. INTRODUCTION
These Terms of Sale (“Terms”) govern the purchase of digital photographs and related digital photographic products from Witness Light Studio, LLC (“Witness Light Studio,” “Photographer,” “we,” “us,” or “our”).
By placing an order for digital photographs, Client (“you” or “your”) acknowledges that they have read, understood, and agreed to these Terms.
These Terms apply to purchases made directly from Witness Light Studio, including purchases made through an online gallery, digital delivery platform, website, invoice, or other authorized sales channel.
Your purchase and use of digital photographs may also be subject to the separate Witness Light Studio Digital Image License Agreement, which governs the rights granted to you after purchase.
2. DIGITAL IMAGE PURCHASES
Digital photographs are sold as individual images, collections, galleries, packages, or other offerings identified at the time of purchase.
The specific photographs, quantity, file format, resolution, and other deliverables included in your purchase will be identified in the applicable order, invoice, gallery, package description, or other written agreement.
Unless expressly stated otherwise, purchasing a digital photograph does not transfer copyright ownership to the Client.
Copyright remains with Witness Light Studio, LLC.
3. PRICES
Prices for digital photographs and related products are the prices displayed or quoted at the time the order is placed.
Witness Light Studio reserves the right to change prices, packages, promotions, and product offerings at any time. Price changes will not affect an order that has already been accepted and paid for.
Unless otherwise stated, prices do not include applicable sales tax or other government-imposed charges that may be required.
4. PAYMENT
Payment must be received in full before purchased digital images are released for download unless otherwise agreed to in writing.
Accepted payment methods may include the payment methods made available by Witness Light Studio or its authorized payment-processing providers.
An order is not considered complete until payment has been successfully received or otherwise authorized.
Witness Light Studio reserves the right to delay delivery until payment has cleared.
5. ORDER ACCEPTANCE
Submitting an order constitutes an offer to purchase the selected digital photographs.
Witness Light Studio reserves the right to decline or cancel an order when reasonably necessary, including circumstances involving:
Pricing or product-description errors.
Technical problems.
Duplicate or fraudulent orders.
Payment-processing problems.
Unauthorized purchases.
Circumstances beyond the Photographer's reasonable control.
If an order is cancelled after payment has been received, Witness Light Studio will provide an appropriate refund of amounts paid for the cancelled order unless otherwise required by law.
6. DIGITAL DELIVERY
Purchased digital photographs will be delivered electronically through the delivery method designated by Witness Light Studio.
Delivery may include:
An online gallery.
A download link.
A digital file transfer.
Email delivery.
Another electronic delivery method designated by Witness Light Studio.
Client is responsible for providing an accurate email address and maintaining access to the account, device, or service necessary to receive the photographs.
Witness Light Studio is not responsible for delivery problems caused by an incorrect email address, inactive account, insufficient storage, spam filtering, unsupported software, or other circumstances outside the Photographer's reasonable control.
7. DOWNLOAD PERIOD
Digital images may be available for download for a limited period depending upon the gallery or delivery service used.
Unless a different period is expressly stated in writing, Client should download and securely back up purchased photographs promptly after delivery.
Witness Light Studio may remove galleries or download access after the applicable delivery period.
Continued hosting or archival availability is not guaranteed unless expressly included as part of the purchased service.
8. CLIENT'S RESPONSIBILITY FOR BACKUPS
Once digital photographs have been delivered and made available for download, Client is responsible for maintaining appropriate backup copies.
Witness Light Studio strongly recommends maintaining at least two independent copies of important photographs.
Witness Light Studio is not responsible for loss resulting from:
Deleted files.
Lost or damaged devices.
Failed storage media.
Accidental overwriting.
Computer or software failures.
Expired download links.
Loss of access to a Client account.
If an image remains available in the Photographer's archive, Witness Light Studio may, at its discretion, provide a replacement download. Additional fees may apply.
9. FILE FORMAT AND IMAGE QUALITY
Digital photographs will be delivered in the file format and resolution specified by Witness Light Studio for the applicable product.
Unless otherwise stated:
Digital files are delivered as finished photographs.
RAW or unedited camera files are not included.
Working files, layered files, or editing project files are not included.
The Photographer determines the final editing, color treatment, cropping, and artistic presentation of delivered photographs.
Differences in color, brightness, sharpness, or appearance may occur between different monitors, devices, operating systems, browsers, and printing services.
Such differences do not necessarily constitute a defect in the delivered photograph.
10. ARTISTIC EDITING
Client acknowledges that photography and image editing involve artistic judgment.
Witness Light Studio retains discretion regarding the artistic style, editing, color correction, cropping, retouching, and final presentation of delivered photographs unless specific editing requirements have been agreed to in writing.
Requests for additional editing or revisions after delivery may be subject to additional fees and are not guaranteed.
11. REFUNDS AND DIGITAL PRODUCTS
Because digital photographs are intangible products that can be downloaded, copied, and retained by the purchaser, all digital-image sales are generally final once the files have been made available for download, except where a refund or cancellation is required by applicable law or expressly approved by Witness Light Studio.
If Client believes a delivered file is corrupted, incomplete, materially different from what was purchased, or otherwise defective, Client should contact Witness Light Studio promptly.
Where reasonably possible, Witness Light Studio will attempt to correct the problem or provide a replacement file.
Nothing in these Terms limits any non-waivable rights or remedies provided to consumers under applicable law.
12. DUPLICATE PURCHASES
Client is responsible for reviewing their order before completing a purchase.
If Client accidentally purchases the same photograph more than once, Client should contact Witness Light Studio as soon as possible.
Duplicate purchases may be eligible for a refund or account credit at the Photographer's discretion, particularly when the duplicate purchase has not yet been downloaded.
13. CHARGEBACKS AND PAYMENT DISPUTES
Client agrees to contact Witness Light Studio first to attempt to resolve billing, delivery, or product concerns before initiating a payment dispute or chargeback.
This provision does not prevent Client from exercising any rights available under applicable law.
Unauthorized chargebacks or payment reversals may result in suspension of download access and may be pursued through appropriate lawful remedies.
14. COPYRIGHT AND LICENSE
All photographs remain copyrighted works of Witness Light Studio, LLC unless copyright ownership has been expressly transferred in a separate written agreement.
The purchase of a digital photograph grants Client only the usage rights expressly provided by the applicable Witness Light Studio Digital Image License Agreement.
Client may not assume that purchasing a digital file gives them the right to:
Sell the photograph.
License the photograph to another party.
Use the photograph commercially.
Claim copyright ownership.
Submit the photograph as their own work.
Use the photograph for advertising or business purposes.
Additional commercial or expanded usage rights may be available through a separate written license.
15. DIGITAL IMAGE LICENSE
By purchasing digital photographs from Witness Light Studio, Client acknowledges that the photographs are subject to the Witness Light Studio Digital Image License Agreement.
The Digital Image License Agreement establishes the permitted uses of the photographs after purchase.
If there is a conflict between these Terms of Sale and a separately executed written contract or custom licensing agreement, the separately executed agreement will control to the extent of the conflict.
16. PERSONAL USE
Unless otherwise stated in writing, digital photographs purchased for personal use are intended for the personal use of the purchasing Client.
Permitted personal uses generally include personal printing, personal photo books, personal backup copies, and sharing on personal social-media accounts, subject to the Digital Image License Agreement.
Use of purchased photographs for business, advertising, commercial promotion, or other commercial purposes requires appropriate written authorization.
17. THIRD-PARTY PRINTING
Client may use purchased digital photographs to order personal prints and products through a professional printing service.
Client is responsible for selecting the printing provider and reviewing any available print-quality options.
Witness Light Studio does not guarantee the color accuracy, cropping, paper quality, or other characteristics of products produced by third-party laboratories or retailers.
18. PERSONAL INFORMATION
Client information provided during an order may include names, email addresses, billing information, and other information necessary to process and fulfill the purchase.
Witness Light Studio will use such information for legitimate business purposes associated with processing, delivering, supporting, and documenting the Client's purchase, subject to applicable law and any applicable privacy policy.
Payment information may be processed through third-party payment providers. Witness Light Studio may not directly receive or store complete payment-card information.
19. FRAUDULENT OR UNAUTHORIZED TRANSACTIONS
Witness Light Studio reserves the right to investigate and take appropriate action regarding suspected fraudulent, unauthorized, or abusive transactions.
This may include cancellation of an order, suspension of download access, or other lawful remedies.
Client agrees not to use another person's payment method or account without authorization.
20. TECHNICAL PROBLEMS
Witness Light Studio will make reasonable efforts to provide functional digital downloads.
However, temporary interruptions may occur because of:
Internet-service interruptions.
Gallery or hosting-platform outages.
Server problems.
Software failures.
Maintenance.
Security incidents.
Events outside the Photographer's reasonable control.
When a technical problem occurs, Witness Light Studio will make reasonable efforts to restore access or provide an alternative delivery method.
21. LIMITATION OF LIABILITY
To the extent permitted by applicable law, Witness Light Studio's liability arising from a digital-image purchase will be limited to the amount actually paid by Client for the affected digital product.
Witness Light Studio will not be responsible for indirect, incidental, special, consequential, or punitive damages except to the extent such limitation is prohibited by applicable law.
Nothing in these Terms is intended to waive rights that cannot lawfully be waived or limited.
22. EVENTS BEYOND REASONABLE CONTROL
Witness Light Studio will not be considered in breach of these Terms for delays or failures caused by circumstances beyond the Photographer's reasonable control.
Such circumstances may include natural disasters, severe weather, fire, power or internet outages, equipment failure, cyber incidents, governmental actions, platform outages, or other extraordinary events.
23. GOVERNING LAW
These Terms shall be governed by and interpreted according to the laws of the State of Montana, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal action arising from these Terms shall be subject to the jurisdiction of courts having appropriate authority under applicable law.
24. CHANGES TO THESE TERMS
Witness Light Studio may update these Terms from time to time.
The Terms applicable to a particular purchase are the Terms in effect when that purchase is accepted, unless a later change is required by law or expressly agreed to by the Client.
25. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
The invalid or unenforceable provision will be interpreted or modified to the extent necessary to make it enforceable while preserving its intended purpose as closely as possible.
26. ENTIRE AGREEMENT
These Terms, together with the applicable order, invoice, photography contract, Digital Image License Agreement, and any other written agreement expressly incorporated into the transaction, constitute the agreement concerning the applicable digital-image purchase.
Any provision specifically negotiated and agreed to in a separate written agreement will control over a conflicting provision of these Terms.
CLIENT ACKNOWLEDGMENT
By completing a purchase of digital photographs from Witness Light Studio, Client acknowledges that:

☐ I understand that digital-image purchases generally do not include a transfer of copyright ownership.
☐ I understand that my use of purchased photographs is governed by the applicable Digital Image License Agreement.
☐ I understand that I am responsible for downloading and backing up my purchased digital photographs.
☐ I understand that digital-image sales are generally final once files are made available for download, subject to applicable law and the refund provisions stated above.
☐ I understand that commercial or business use may require a separate written license.
